Purpose of Processing (Purpose and Legal Basis)

The company Artemis Lodge, whose registered office is located at 111 Chemin du Logis, 85300 Soullans, France, operates an online sales website. This website enables the receipt of customer orders, and the data collected on this occasion are recorded and processed in a customer database.

This database is used to:

Manage orders, payments, and deliveries.
Carry out marketing activities (customer loyalty programs, promotions) and send advertising emails to customers who have not objected to this or who have given their consent:
- For products similar to those they have ordered.
- For other products or services offered by the company. For example, if a customer purchases a kitchen apron, a kitchen towel may be offered to them.

Legal Bases for Processing

Order management: the legal basis for processing is the performance of a contract (see Article 6(1)(b) of the General Data Protection Regulation – GDPR).
Sending marketing emails about products similar to those ordered by customers: the legal basis for processing is the legitimate interest of the company (see Article 6(1)(f) of the GDPR), namely promoting our products to our customers.
Sending marketing emails about other products offered by Artemis Lodge: the legal basis for processing is consent (see Article 6(1)(a) of the GDPR), as required by Article L.34-5 of the French Postal and Electronic Communications Code.
Transfer of email addresses to commercial partners: although the legal basis for such processing would be consent (see Article 6(1)(a) of the GDPR), this does not apply in this case, as this data will never be shared with any third party for advertising or commercial prospecting purposes.
Accounting records requiring data retention for a period of 10 years: the legal basis for processing is a legal obligation (see Article 6(1)(c) of the GDPR).

Categories of Data

Identity data: title, last name, first name, address, delivery address, telephone number, email address, date of birth, internal processing code enabling customer identification, data relating to registration on opt-out lists.
Order-related data: transaction number, details of purchases, purchase amounts, data relating to payment of invoices (payments, outstanding amounts, discounts), product returns.
Payment method data: credit card number, credit card expiry date, visual cryptogram (which is immediately deleted).
Data required for loyalty and prospecting actions: purchase history.

Data Recipients

The customer service and billing departments of Artemis Lodge are recipients of all categories of data.
Its subcontractors responsible for order delivery are recipients of customers’ identity data, address, and telephone number.
Customers’ email addresses will never be shared with any third party for advertising or commercial prospecting purposes. However, the data processing register must be made available to the CNIL upon request, in particular as part of its data processing control missions.

Data Retention Period

Data necessary for order management and invoicing: for the duration of the commercial relationship and ten (10) years in accordance with accounting obligations.
Data necessary for loyalty and prospecting actions: for the duration of the commercial relationship and three (3) years from the date of the last purchase.
Payment method data: this data is not stored by Artemis Lodge; it is collected during the transaction and deleted immediately once the purchase is completed.
Data relating to opt-out lists for marketing communications: three (3) years.

General Terms and Conditions of Sale (GTC)

Private Customers

The essential characteristics of the goods, products and/or services are described on each product page available for sale on the Artemis Lodge website under the “description” section.
Additional information may be provided under various sections on the sales page as well as on the purchase page referred to as the “cart”.
Prices displayed on the Artemis Lodge website are inclusive of all taxes (TTC) and in euros. If the euro is not the buyer’s local currency, the exchange rate and related fees depend on the buyer’s bank policy. Artemis Lodge shall not be held responsible for any price difference resulting from currency conversion.
Delivery fees, dates and terms are communicated at the time of order placement and may vary depending on the delivery country.
An order placed online constitutes a contract between the seller and the buyer. The seller, Artemis Lodge, is required to fulfil the order once the total amount including taxes in euros has been received in its bank account and the buyer has accepted the general terms and conditions of sale.
Accepted payment methods: credit card (PayPal, Apple Pay, if applicable).
Late payment: N/A.
Right of withdrawal: You may cancel your online order within fourteen (14) days from the day following receipt of the goods and receive a refund of the total amount paid, excluding delivery costs. Return shipping costs are borne by the buyer.
Artemis Lodge guarantees that the products sold on its website conform to their descriptions on the respective product pages. Each product is checked prior to dispatch to ensure it is in proper condition. Any issues related to product delivery are handled by the delivery service, and Artemis Lodge shall not be held responsible for damage caused by the carrier.
Commercial warranty and after-sales service (cost of remote communication: according to your telecom operator and subscription).
Dispute resolution: Commercial Court of La Roche-sur-Yon.
